
March 5, 2009 oral argument of counsel before the Supreme Court of Alabama sitting in a special setting at The University of Alabama School of Law in Tuscaloosa, Alabama. The case is Leytham v. DBI, Inc., f/k/a Duck Boo International Co., Ltd., Sup. Ct. case no. 1071433. At issue is whether the Circuit Court of Mobile County can assert personal jurisdiction over Duck Boo, a Korean manufacturer of seat belt assemblies imported to The United States through automobile manufacturers such as Kia and Daewoo.
16-year old Tonya Leytham died when her Kia Sephia automobile left the roadway in Mobile and she was ejected. Tonya's mother filed suit against Duck Boo claiming that its seat belt assembly was defective and unreasonably dangerous.
