Medical Malpractice

A critical study by the Institute of Medicine reports that there are twice as many deaths caused by malpractice in hospitals than deaths attributable to automobile accidents in this country. Whether the result of poor communication, understaffing, failure to adhere to mandatory policies and procedures, use of the wrong drugs, misdiagnoses, or botched medical procedures, serious injuries and deaths attributable to malpractice are now a fact of everyday life.

Medical malpractice takes many forms, ranging from negligence that results in birth defects or injuries, to elder abuse in nursing homes.  It can happen during any kind of hospital visit, from a trip to the emergency room to an outpatient surgery, or an extended stay.

Our lawyers thoroughly evaluate the underlying merits of each medical malpractice case before filing a lawsuit. We will only proceed with a malpractice case if it is truly legitimate and supported by highly qualified experts. The defendants in these cases rely upon the substantial financial resources of their insurers who aggressively defend cases even when there has been clear medical negligence. Despite the financial resources of the insurance companies supporting the defendants, we continue to achieve success at trial due to our commitment to justice and to our clients.

If you suspect you or a loved one has been the victim of medical malpractice, call us to arrange a consultation to discuss your case.

The Scope of a Nurse's Duty of Care

According to the American Nurses Association (ANA), "The nurse promotes, advocates for, and strives to protect the health, safety, and rights of the patient." But what should happen when a nurse's failure to promote or advocate for his or her patient's health, safety, or tights results in injury? Are nurses expected simply to follow orders, or are they bound to question those orders when something is amiss? This article summarizes some of the issues.
