WANTONNESS / STATUTE OF LIMITATIONS - WALKER V. CAPSTONE BUILDING CORPORATION
In Walker v. Capstone Building Corporation, [Ms. 2081153, March 26, 2010] ___ So.3d ___ (Ala. Civ. App. 2010), the Alabama Court of Civil Appeals held that the statute of limitations for wantonness claims is six years, and based its ruling on the recent Alabama Supreme Court opinions Carr v. International Refining & Manufacturing Co., 13 So.3d 947 (Ala. 2009), and McKenzie v. Killian, 887 So.2s 861 (Ala. 2004). The Court reversed the trial court's order granting summary judgment and remanded the case for further proceedings.
