Appeal Dismissed for Lack of Final Judgment—Order Failing to Adjudicate All Claims of All Parties Is Nonfinal

|

Kyndra Granillo, Tyler Pittman, and Allison Ace v. Marie Garrison and Leassia Hanback, [Ms. CL-2025-0303, Feb. 13, 2026] __ So. 3d ___ (Ala. Civ. App. 2026). The court (Moore, P.J., and Edwards, Hanson, and Bowden, JJ., concur) dismisses Granillo, Pittman, and Ace’s appeal from the Franklin Circuit Court’s judgment ordering Granillo to vacate certain real property and remove her belongings. The central issue on appeal was whether the Court’s order constituted a final judgment sufficient to invoke appellate jurisdiction. Ms. *1-2.

The court reiterates that a final judgment must dispose of all claims as to all parties before an appeal may proceed. The court further explains that because the court’s order resolved only the claims against Granillo and left the claims against Pittman and Ace pending, the order was not final and would not support appellate review. Ms. *2.

For that reason, the court concludes it lacks jurisdiction and dismisses the appeal. Their decision reinforces that appellate courts may review only judgments that fully adjudicate the rights and liabilities of every party involved in the action. Ms. *2.
