On July 6, 1997, J.D. Johnson and her Delchamps co-worker, Tony Dodd, were shot by a coworker who had been disciplined, placed under suspension, and told to leave the premises. The coworker left the store while under watch of a Kirkland Investigations security guard. The coworker retrieved a fire arm from his automobile, re-entered the store, passed directly by the Kirkland security guard, walked to the bakery and shot J.D. Johnson and Tony Dodd.
The Kirkland security guard took no action to protect Ms. Johnson, Mr. Dodd and the other employees or business invitees to the store; rather, he ducked and hid like a coward when the assailant began firing at Ms. Johnson and Mr. Dodd.
