In this personal injury case, the plaintiff was a friend and guest in the home of the defendant. While the plaintiff was visiting, the defendant took out a firearm knowing it was loaded and that the safety was off, which violates basic gun safety rules provided by the National Rifle Association of America. The defendant admitted to detectives that the gun was loaded because she did not understand how to unload it. The defendant handled the gun in a negligent and reckless fashion after drinking several alcoholic beverages, and shot the plaintiff in the leg causing severe injuries. The plaintiff underwent emergency surgery, extensive rehabilitation and suffered permanent injuries resulting in an altered lifestyle.
