Smith v. Renter's Realty, [Ms. 2180304, July 12, 2019] __ So. 3d __ (Ala. Civ. App. 2019). The court, per curiam, with all judges concurring, remands a judgment of the Madison Circuit Court which denied a claim of exemption in connection with a writ of garnishment to afford the Attorney General the opportunity to appear and be heard pursuant to § 6-6-227, Ala. Code 1975, and Armstrong v. Roger's Outdoor Sports, Inc., 581 So. 2d 414 (Ala. 1990), on whether to weigh in on the issue of the constitutionality of § 6-10-6.1, Ala. Code 1975, which purports to exempt wages, salaries, and other compensation from the list of exemptions from garnishment, levy, sale under execution, and other process for the collection of debts.
