Cunningham Bounds Secures $5 Million Verdict Against Springhill Medical Center

Cunningham Bounds is proud to announce that attorneys Jenna York and Robert Mitchell secured a $5,000,000 verdict against Springhill Medical Center following a six-day jury trial in Mobile County. The jury returned its verdict on August 25th.

The case involved a 76-year-old woman who self-admitted to the hospital with chest pain. After a three-day stay, she underwent a cardiac catheterization procedure with stenting. Later that night, after being placed on the side of her bed and left unattended, she suffered a fall event. The incident resulted in a traumatic brain injury (TBI) requiring an emergency craniotomy, leaving the plaintiff with significant and permanent cognitive deficits.

At trial, the plaintiff’s team argued that the standard of care required closer supervision and implementation of fall prevention measures. The hospital’s own policies, Joint Commission literature, and a yellow fall-risk wristband all confirmed the plaintiff was a fall risk. Despite this, her nurse left her in an exposed position, unattended and unprotected.

“No one goes into the hospital for a routine stent procedure expecting to leave with titanium plates in their skull and a profound brain injury,” said Ms. York, who emphasized the life-altering consequences of the hospital’s negligence.

Before the incident, the plaintiff was fully independent. Since the fall, her quality of life has been drastically diminished. The jury’s $5 million verdict reflects both the severity of her injuries and the hospital’s failure to uphold basic patient safety protocols.
