PROPER MEASURE OF DAMAGES FOR BREACH OF CONTRACT IN A SALE OF LAND - RADECTIC V. MURPHY

In Radectic v. Murphy, [Ms. 1091462, Apr. 15, 2011] __ So. 3d __(Ala. 2011), the Alabama Supreme Court reemphasized its earlier holdings that the proper measure of damages for a breach of contract in a sale of land is the difference between the contract price and the market value at the time of the breach D not at the time of its sale.
