Dependency - Due Process

R.R. and P.W.R. v. Chilton County Department of Human Resources, [Ms. 2170334, Sept. 21, 2018] __ So. 3d __ (Ala. Civ. App. 2018). This unanimous decision by Judge Thomas reverses the Chilton Juvenile Court’s judgment declaring the parties’ child dependent. Noting “a parent is entitled to due process in proceedings involving the custody of a child,” Ms. *4, quoting Strain v. Maloy, 83 So. 3d 570, 571 (Ala. Civ. App. 2011), the Court reversed because the Juvenile Court did not receive any evidence at the adjudicatory hearing concerning the child’s dependency.
