County Boards of Education – Sovereign Immunity

Ex parte Jefferson County Board of Education, [Ms. 1200230, Sept. 3, 2021] __ So. 3d __ (Ala. 2021). The Court unanimously (Bryan, J.; Parker, C.J., and Bolin, Shaw, Wise, Sellers, Mendheim, Stewart, and Mitchell, JJ., concur) issues a writ of mandamus directing the Jefferson Circuit Court to dismiss Alabama Lockers, LLC’s contract action against the Jefferson County Board of Education. The Court rejects the plaintiff/respondent’s request to overturn its settled precedent holding that county boards of education are entitled to sovereign immunity, “[w]e reaffirm our holding in [Ex parte] Hale [County Board of Education, 14 So. 3d 844 (Ala. 2009),] stating that county boards of education are entitled to State immunity.” Ms. *12.
