Newman’s Medical Services, Inc., et al. v. Mobile County, et al., [Ms. 1210001, June 17, 2022] __ So. 3d __ (Ala. 2022). The Court (Shaw, J.; Parker, C.J., and Bryan, Mendheim, and Mitchell, JJ., concur) affirms the Mobile County Circuit Court’s summary judgment dismissing claims asserted by Newman’s Medical Services, Inc. (“Newman’s Medical Services”) against Mobile County and Mobile County Emergency Medical Services System Rescue Squad, Inc. (“EMS”), alleging that the annual contract between EMS and Mobile County was subject to the competitive bid law, § 41-16-50, et seq., Ala. Code 1975. The Court concludes that the contract between the County and EMS falls within an exception to the competitive bid law for “‘[c]ontractual services and purchases of products related to, or having an impact upon, ... the ... safety of persons....’ § 41-16-51(a)(15).” Ms. **12-13.
