$5 Million Settlement Against Wells Fargo Home Mortgage for Use of Improper Affidavits

Firm partners Steve Olen and Steve Nicholas obtained a $5 million settlement against Wells Fargo Mortgage for the use of improper affidavits in bankruptcy courts. The affidavits were improper because the signature pages were executed separately from the other pages of the document, employees of Wells Fargo testified that they signed sworn affidavits without reading them and some affidavits contained incorrect or misleading titles and statements regarding the review process.

The court certified a class of affected debtors in the Southern District of Alabama, and a settlement class of all affected debtors in Alabama received final approval in November 2014.
