What Makes Maritime Law Different?
Maritime law is a separate jurisdiction from national laws and is based on its own separate set of rules and codes. It is the law that typically governs insurance claims relating to cargo, ships, and piracy as well as disagreements between ship owners, seamen and passengers.
Seamen who are injured offshore are entitled to certain protections and benefits. This body of law applies to seamen, ship owners, and those who ship cargo via water.
Under maritime law, a ship owner is obligated to do the following:
- To provide a vessel that is seaworthy, meaning it is maintained, equipped, and staffed
- To provide maintenance and cure benefits to the injured seaman until he or she recovers
Maintenance and cure benefits are also designed to cover things such as food, rent, transportation, and other necessary expenses as determined by the courts. In addition, cure benefits would cover a variety of hospital and doctor bills. All concerns about obligations are expected to be resolved in the injured seaman’s favor.
