Mandamus Petition Timeliness - Motion To Reconsider: Ex Parte A.J.

|

Ex parte A.J., [Ms. 2170217, Jan. 12, 2018] __ So. 3d __ (Ala. Civ. App. 2018). This unanimous decision by Judge Thomas (Thompson, P.J., and Pittman, Moore, and Donaldson, JJ., concur) dismisses the mother’s petition for writ of mandamus challenging interlocutory orders of the Jefferson Juvenile Court in a paternity action. The court found the mandamus petition was untimely because it was filed more than fourteen days after the interlocutory orders challenged by the petition. Ms. *5-6. The court noted that while the mother had filed a motion to reconsider with the juvenile court, such motion did not extend the time for filing a petition for writ of mandamus by the mother. Ms. *6, citing Ex parte Troutman Sanders, LLP, 866 So. 2d 547, 549-50 (Ala. 2003).
