Denial of Motion to Quash Garnishment Not Appealable

|

Miller Construction, LLC v. DB Electric and Shank, [Ms. 2190467, Jan. 15, 2021], ___ So. 3d ___ (Ala. Civ. App. 2021). The court (Edwards, J.; Thompson, P.J., and Moore, Donaldson, and Hanson, JJ., concur) dismisses Miller Construction, LLC’s appeal from the Baldwin Circuit Court’s denial of its motion to quash a garnishment to Trustmark National Bank seeking to collect on a judgment against Miller Construction. The court dismisses the appeal because “[t]he order denying the motion to quash filed by the LLC and Miller addressed only the disposition of that motion ... [and] is not a final judgment and is not capable of supporting this appeal.” Ms. *5.
